Common Law Obligations of Departing Employees

According to Richard B. Smith (of BDP, a law firm in Calgary) in an article he wrote for his firm’s On Record spring 2004 newsletter (VOL.2/ ISSUE #1), he lays out some of the precedents that have been established - namely in Alberta - when an employee has departed his employer, giving examples of some of the potential consequences for both sides when the departed tries to work with a direct competitor. Something very likely to occur in this tight job market. (Of course, because the information provided is general in nature, you should contact your legal counsel or the BDP people directly to get specific legal advice about your personal circumstances). Anyway, some good food for thought here.
